Child Visa (Subclass 101 or Subclass 802)
SUBCLASS 101
This visa is designed for children who are located outside Australia and want to join their parent(s) who are Australian citizens, permanent residents, or eligible New Zealand citizens. Here is some key information about Subclass 101:
Key Requirements:
1. Age:
- Under 18 years old, or
- Over 18 and under 25 years and studying full time. The child must be financially dependent on their parent more than any other person, or
- Over 18 years with a disability
2. Relationship: The child must be the biological child, adopted child, or stepchild of the sponsoring parent.
3. Marital status: If the child is 18 years or older, they must not be married or in a de facto relationship
4. Health and Character: The child and their accompanying family members must meet health and character requirements.
SUBCLASS 802
This visa is similar to subclass 101. However, it allows the visa applicant allows the child to remain in Australia and continue their education while waiting for the visa application decision.
The application must be lodged onshore.
Dependent Child Visa (Subclass 445)
The Subclass 445 visa is designed for dependent children of parents who hold a temporary partner visa, including Subclass 309 or 820. It allows the child to remain in Australia with their parent until a decision is made on the parent’s permanent partner visa application. Here is some key information about Subclass 445:
Key Requirements:
1. Age:
- Under 18 years old, or
over 18 years and financially dependent on the parent who has the Temporary Partner visa
2. Relationship: The child must be the biological child, adopted child, or stepchild of the sponsoring parent.
3. Marital status: If the child is 18 years or older, they must not be married or in a de facto relationship
4. Health and Character: The child and their accompanying family members must meet health and character requirements.
Adoptive Visa (Subclass 102)
The Subclass 102 visa is designed for children who are adopted or in the process of being adopted by an Australian citizen, permanent resident, or eligible New Zealand citizen. It allows the child to live permanently in Australia with their adoptive parent(s). Here is some key information about Subclass 102:
Applicant’s requirements:
- Age: The child must be under 18 years of age at the time of visa application.
- Adoption: The child must have been adopted or be in the process of being adopted by an Australiancitizen, permanent resident, or eligible New Zealand citizen.
- Adoption in Compliance: The adoption must be recognized as valid and in compliance with the laws of the child’s home country and Australia.
- Legal Custody: The adoptive parent(s) must have legal custody of the child.
Sponsor Requirements:
- Australian Citizen or Permanent Resident: The sponsor must be an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Adoption Process: The sponsor must be actively involved in the adoption process or have already completed the adoption.
- The sponsor must have resided outside the Australia for more than 12 months at the time of the visa application.
