How many subclasses of Partner visa?

1. Partner Visa Subclasses 820 and 801 (Onshore):

  • The subclass 820 is a temporary visa that allows you to live in Australia with your Australian partner.
  • Once you hold a subclass 820 visa and meet the eligibility requirements, you can apply for the subclass 801 visa, which is a permanent visa after two years from the date of application of subclass 820.
  • The subclass 820 visa is applied for and granted while you are in Australia.
  • You have the benefit of staying in Australia with your partner throughout the application process via bridging visas.

2. Partner Visa Subclasses 309 and 100 (Offshore):

  • The subclass 309 is a temporary visa that allows you to enter and stay in Australia with your Australian partner.
  • Once you hold a subclass 309 visa and meet the eligibility requirements, you can apply for the subclass 100 visa, which is a permanent visa, after two years from the date of application of subclass 309
  • The subclass 309 visa is usually applied for and granted while you are outside of Australia.
3. Prospective Marriage Visa Subclass 300
  • This visa is designed for individuals who are engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen. It allows the visa holder to enter Australia and marry their intended spouse within the validity period of the visa.
  • After the marriage takes place, the visa holder can apply for a Partner visa Subclass 820/801 to obtain permanent residency in Australia.

Can I include my children with my Partner visa application?

Yes. You can include dependent children in your initial application or add them later when:
  • Before the temporary visa (Subclass 309 or 820) application is finalised.
  • After the temporary visa (Subclass 309 or 820) application is finalised and you are holding a temporary partner visa (Subclass 309 or 820), we can include your children via Depent child visa Subclass 445

How many time a sponsor can sponsor his/her partner via Partner Visa ?

You can sponsor up to two different overseas partner in your life. In some case, there are exceptions. Exceptional circumstances encompass a range of situations, which may include, but are not limited to:

  • The presence of a dependent child who relies on both the applicant and their sponsor.
  • The unfortunate event of a previous partner’s passing.
  • The sponsor was abandoned by their former spouse, while having dependent children in need of the sponsor’s care and support
  • The establishment of a long-standing relationship between the applicant and sponsor.

When evaluating these circumstances, the Department of Home Affairs considers the following factors:

  • The specific nature of the hardships or detriments that would befall the sponsor if the sponsorship were not approved.
  • The extent and significance of the sponsor’s ties to Australia, as well as the potential hardships or detriments that would arise if the sponsorship were denied, leading the sponsor to feel compelled to leave Australia in order to maintain their relationship with the applicant.
